Bradenton Man Cleared in Shooting After Judge Upholds Stand Your Ground Defense
A Manatee County judge has dismissed aggravated assault charges against a Bradenton man after ruling that his actions were protected under Florida’s Stand Your Ground law.
Circuit Judge Frederick Mercurio granted the defense motion for Kevin Armstrong, concluding that he acted in self-defense during a confrontation with his ex-girlfriend and two men outside his home. The judge found that Armstrong’s fear of harm was reasonable under the circumstances, effectively ending the criminal case against him.
The incident occurred when Armstrong’s former girlfriend, Caitlin Lipke, went to his home with two men identified as Cole Banyas and Dylan Taylor. According to court filings, the men were armed and exchanged gunfire with Armstrong, with investigators later finding multiple rounds had been fired toward the residence.
During the altercation, Lipke was shot in the chest and survived. The court heard that Armstrong had initially fired a warning shot when the group approached and that his actions were consistent with a response to a perceived threat.
Judge Mercurio’s ruling determined that Armstrong was justified in his use of force under Florida’s Stand Your Ground statute, which provides immunity from prosecution for individuals who use force in self-defense when faced with imminent danger.
The decision brings an end to the case pending the formal entry of the dismissal order.
