Manatee County Moves Toward Possible Ban on Kratom and Designer Drugs
Manatee County could soon become the second county in Florida to enact a complete ban on kratom and other designer drugs, following Sarasota County, which adopted a similar ordinance in 2014.
On Tuesday, commissioners voted 4-3 to direct county staff to research the issue and return with a draft ordinance. Commissioner Amanda Ballard proposed the measure, which would prohibit kratom along with synthetic cannabis and other designer substances. Commissioners George Kruse, Bob McCann, and Jason Bearden opposed the motion.
Kratom, a tropical tree native to Southeast Asia, is used in products often sold in smoke and vape shops. The Drug Enforcement Administration says it can act as a stimulant in small doses and as a sedative at higher doses, with risks that include liver toxicity, seizures, and addiction. While some residents credit kratom with helping them recover from opioid or painkiller dependency, the Food and Drug Administration has not approved it for medical use.
In August, Attorney General James Uthmeier classified 7-hydroxymitragynine, a chemical compound found in kratom, as a Schedule 1 controlled substance in Florida, placing it in the same category as heroin and LSD. Advocates for broader restrictions argue that banning kratom and its derivatives at the county level would prevent manufacturers from skirting regulations by altering chemical formulas.
Law enforcement leaders have voiced support. Sheriff Rick Wells and Bradenton Police Chief Josh Cramer submitted letters backing the proposal, citing the risks of addiction, unpredictable effects, and the strain on public safety resources. They said a countywide ordinance would help streamline enforcement.
Public comments reflected division in the community. Two residents submitted statements describing how kratom helped them overcome dependence on other drugs and regain stability in their lives.
Commissioners debated whether a ban was necessary, with some arguing that age restrictions already in place are sufficient. Despite objections, the board voted to advance Ballard’s proposal for further study.
If enacted, the ordinance would align with Sarasota County’s rules and make Manatee the only other Florida county with a full ban on kratom and other designer drugs.
